Fired HR chief of tech company wins partial revival of bias lawsuit

Government contractor Intelligent Waves Inc. saw the swift defeat of an elderly French-Canadian HR manager’s employment discrimination case partially overturned Wednesday by a U.S. appeals court.

The Virginia federal judge who reviewed the woman’s age and national origin discrimination claims against the company raised her complaint to an inappropriately higher level when he decided to dismiss the lawsuit, the U.S. Court of Appeals said for the Fourth Circuit.

Job bias plaintiffs don’t have to argue a “but-for” reason in their lawsuits, even though they will have to demonstrate that level of causation to ultimately prove their claims, the appeals court said. …
